1. Scope
These terms apply to all services provided by Pakun AI (including websites, SEO/GEO services, AI call protection, analyses, consulting and implementation) to businesses within the meaning of § 14 BGB. Orders are subject to express confirmation. Pakun AI does not contract with consumers. Different or additional customer terms apply only if Pakun AI expressly agrees to them in text form.
2. Scope of services
Services are provided according to the relevant description (offer, email or service page on pakunai.de at the time of ordering). Reports, analyses and measurements are snapshots. Unless a specific result is expressly agreed, such as the creation of a website, Pakun AI owes careful performance of services, not a particular commercial outcome.
2a. SEO/GEO services
SEO/GEO services prepare content, technical information and business data so that search engines and AI assistants can understand and cite them. No ranking, visibility, traffic, enquiries, revenue or citation in AI answers is guaranteed. Search engines and AI providers decide what to show.
Measurements use Google Search Console, Bing Webmaster Tools (including Copilot citation information where supplied), Google Business Profile statistics where access is granted, and our own technical checks. AI answers are not queried or analysed manually or automatically. Missing values are marked unavailable.
Customers are responsible for the accuracy, completeness and legality of their information and materials and confirm they hold the necessary rights. They indemnify Pakun AI against third-party claims based on supplied content to the extent they are responsible for the infringement. Missing cooperation extends delivery times accordingly.
Content intended for publication on the customer website, Google Business Profile or directory entries is submitted for approval in text form. The customer checks factual accuracy. Approval is deemed given if the customer does not object or request changes in text form within seven days of receipt, provided Pakun AI expressly draws attention to this consequence in the submission. Corrections may be requested after publication. Legal review of content is not included.
If the website is not hosted by Pakun AI, files and integration instructions are provided; Pakun AI is not responsible for integration by the customer or their providers. Customer accounts remain theirs; granted permissions may be revoked at any time. Directory entries are created only with customer authority.
2b. Third-party services
Search engines, AI providers, Google, Microsoft and directory operators independently decide on inclusion, display, verification, suspension and deletion and may change services, interfaces and policies. Pakun AI is not liable for these decisions unless caused by its culpable breach of duty; section 6 then applies. If a measurement source is discontinued or changed, that report component is omitted; other services remain unaffected.
3. Fees and payment
Fees follow the offer or price list. Payment is made in advance by Stripe payment link. All prices are final prices; no VAT is charged under § 19 UStG. If payment is more than 14 days overdue, Pakun AI may suspend ongoing services until payment after prior notice in text form.
3a. Monthly services
The German-market SEO/GEO support subscription (€149 per month) has a minimum term of six months, then renews monthly. Cancellation must be received in text form no later than 14 days before the end of the minimum term or renewal month; an email to [email protected] suffices. Monthly amounts are collected in advance through Stripe. This also applies to support in the website plus SEO/GEO combination. Extraordinary termination for good cause remains possible. Other monthly services have the terms stated in their respective offers.
3b. Referral programme
For each successful, paid engagement arising from a referral, Pakun AI pays a one-off €100 reward (a flat amount, not a flat-rate right to a price reduction) after completion of the first paid project. Self-referrals and certain relationships, including close relatives and affiliated businesses, are excluded. Payment is by bank transfer or credit against an own project. Entitlement arises only when Pakun AI confirms the reward in writing.
3c. Instant purchase: Visibility Check (Website & Search)
For the Visibility Check (Website & Search), available at pakunai.de/handwerk/sichtbarkeits-check/, the following supplements and overrides section 1 sentence 2 and section 3:
(1) Formation of contract: By submitting the order, the purchaser makes an offer. The contract is formed upon successful completion of payment through the payment service provider Stripe; no separate confirmation is required.
(2) Businesses only: Instant purchase is available exclusively to businesses within the meaning of § 14 BGB. The purchaser confirms this when ordering and warrants that they are authorised to commission services for the specified website. There is no right of withdrawal, as this is available only to consumers.
(3) Service: Pakun AI automatically creates a report on the homepage of the specified website (including accessibility of the site, technical information for search engines and Google PageSpeed, where the interface responds) and its discoverability for selected search queries via a metasearch, with an assessment and suggested measures. The report is a snapshot. Answers from AI assistants (e.g. ChatGPT, Gemini, Perplexity) are not measured. Pakun AI owes careful performance of the checks, not particular rankings or results.
(4) Delivery: The report is emailed to the address provided when ordering, generally within 24 hours of receipt of payment. If the website is unavailable or a measurement service does not respond, the report records this finding.
(5) Price and payment: The price is €29 and is a final price; no VAT is charged under § 19 UStG. Payment is in advance through Stripe using the payment methods offered there.
(6) Otherwise, these terms apply, particularly section 5 (Results and usage rights) and section 6 (Warranty and liability).
3d. Instant purchase: SEO/GEO Analysis with Action Plan
For the SEO/GEO Analysis with Action Plan, available at pakunai.de/handwerk/analyse/, the following supplements and overrides section 1 sentence 2 and section 3:
(1) Formation of contract: By submitting the order, the purchaser makes an offer. The contract is formed upon successful completion of payment through the payment service provider Stripe; no separate confirmation is required.
(2) Businesses only: Instant purchase is available exclusively to businesses within the meaning of § 14 BGB. The purchaser confirms this by ticking the relevant box when ordering and warrants that they are authorised to commission services for the specified website. (3) Service: Pakun AI automatically creates a report on the specified website: checks of up to 25 publicly accessible pages (including page titles, descriptions, headings, indexability and structured data), robots.txt and sitemap, Google PageSpeed (where the interface responds), discoverability for selected search queries via a metasearch, consistency of name, address and telephone number (where publicly verifiable), comparison with up to three competitors based on publicly measurable features of their homepages, a cross-check of typical customer questions and a 30/60/90-day plan. The report is a snapshot. Answers from AI assistants are not measured. Pakun AI owes careful performance of the checks, not particular rankings or results.
(4) Delivery: The report is emailed to the address provided when ordering, generally within 24 hours and no later than three business days after receipt of payment. If the website is unavailable or a measurement service does not respond, the report records this finding.
(5) Price and payment: The price is €149 and is a final price; no VAT is charged under § 19 UStG. Payment is in advance through Stripe using the payment methods offered there.
(6) Credit: If the purchaser books SEO/GEO Setup within 30 days of paying for the analysis, the full analysis price is credited against the setup price. The purchaser must provide the voucher code from the report when booking. The code is valid only for the purchaser, is non-transferable and cannot be redeemed for cash; it expires after 30 days.
(7) Otherwise, these terms apply, particularly section 2a (SEO/GEO services), section 5 (Results and usage rights) and section 6 (Warranty and liability).
3e. Instant purchase: Accessibility Check (BFSG)
For the Accessibility Check (BFSG), available at pakunai.de/handwerk/barrierefreiheit/, the following supplements and overrides section 1 sentence 2 and section 3:
(1) Formation of contract: By submitting the order, the purchaser makes an offer. The contract is formed upon successful completion of payment through the payment service provider Stripe; no separate confirmation is required.
(2) Businesses only: Instant purchase is available exclusively to businesses within the meaning of § 14 BGB. (3) Service: Pakun AI automatically checks the homepage and up to ten further publicly accessible subpages of the specified website using axe-core against the automatically testable criteria of WCAG 2.0, 2.1 and 2.2 (levels A and AA), and creates a report with the main defects found, a list of measures and a general explanation of the German Accessibility Strengthening Act (BFSG). Automated tests cover only some possible barriers; the report is a snapshot. Pakun AI owes careful performance of the automated checks, not a particular result, especially not the accessibility of the website or its compliance with the BFSG or other regulations. The report is neither legal advice nor a conformity assessment.
(4) Delivery: The report is emailed to the address provided when ordering, generally within 24 hours and no later than three business days after receipt of payment. If the website is unavailable, the report records this finding.
(5) Price and payment: The price is €49 and is a final price; no VAT is charged under § 19 UStG. Payment is in advance through Stripe using the payment methods offered there. The invoice is emailed.
(6) Otherwise, these terms apply, particularly section 5 (Results and usage rights) and section 6 (Warranty and liability).
3f. Emergency Service Page
For the Emergency Service Page, available at pakunai.de/auftrag/notdienst/, the following supplements and overrides section 1 sentence 2 and section 3:
(1) Formation of contract: By submitting the order, the purchaser makes an offer. The contract is formed upon successful completion of payment through the payment service provider Stripe; no separate confirmation is required.

The content is based exclusively on the customer’s information; the customer is responsible for its accuracy and lawfulness, particularly emergency service hours, service area, price information under the German Price Indication Ordinance and legal notice details; section 2a(3) applies accordingly. The legal notice and privacy notice are template texts based on the customer’s information and are not legal advice. Pakun AI owes creation of the page, not calls, orders or search engine rankings.
(4) Hosting: Pakun AI provides the page through Cloudflare Pages at no separate charge, at a Pakun AI address or a customer subdomain once the customer has set the required DNS record. Customers can update their information through the fact sheet at any time; changes are published after renewed approval. No specific availability is owed; Pakun AI remedies disruptions to the extent reasonably practicable. Pakun AI may terminate free hosting by giving three months’ notice to the end of a month in text form; the customer then receives the page files on request. The customer may terminate hosting at any time in text form.
(5) Delivery: The preview is generally provided by email within 72 hours of receipt of the complete fact sheet. Pakun AI requests missing or unclear information by email; the period then begins upon receipt of that information.
(6) Price and payment: The price is €290 and is a final price; no VAT is charged under § 19 UStG. Payment is in advance through Stripe using the payment methods offered there. The invoice is emailed.
(7) Otherwise, these terms apply, particularly section 5 (Results and usage rights) and section 6 (Warranty and liability).
3g. Google Post Calendar
For the Google Post Calendar, available at pakunai.de/auftrag/beitragskalender/, the following supplements and overrides section 1 sentence 2 and section 3:

(3) Service: Pakun AI automatically creates a 12-month topic plan and 12 draft posts for the customer’s Google Business Profile from the information in the customer’s fact sheet, and delivers both as a PDF and text file by email. Drafts are created using a language model operated on Pakun AI’s own servers or fixed templates, and are automatically checked for statements without a basis in the fact sheet. Pakun AI does not publish posts; checking and publishing the drafts is the customer’s responsibility. Section 2a(3) applies accordingly. Pakun AI owes careful preparation, not reach, calls or rankings.
(4) Delivery: Generally within 24 hours and no later than three business days after receipt of the complete fact sheet.
(5) Price and payment: The price is €99 and is a final price; no VAT is charged under § 19 UStG. Payment is in advance through Stripe using the payment methods offered there. The invoice is emailed.
(6) Otherwise, these terms apply, particularly section 5 (Results and usage rights) and section 6 (Warranty and liability).
3h. Pakun Sichtbar
For “Pakun Sichtbar”, available at pakunai.de/auftrag/sichtbar/, the following supplements and overrides section 1 sentence 2, section 3 and section 3a:
(1) Formation of contract: By submitting the order, the purchaser makes an offer. The contract is formed upon successful completion of payment through the payment service provider Stripe; no separate confirmation is required.
(2) Businesses only: Orders are available exclusively to businesses within the meaning of § 14 BGB. The purchaser confirms this by ticking the relevant box when ordering. There is no right of withdrawal, as this is available only to consumers.
(3) Service: Pakun AI maintains the customer’s Google Business Profile on an ongoing basis. Each month, Pakun AI creates four draft posts from the information in the customer’s fact sheet (using a language model operated on Pakun AI’s own servers or fixed templates, automatically checked for unsupported statements) and publishes them weekly if the customer has invited Pakun AI to be a manager of the profile; otherwise the customer receives the drafts to publish themselves. Pakun AI drafts replies to new reviews and publishes them only with the customer’s consent in text form. Pakun AI compares the customer’s name, address, telephone number and website with publicly discoverable entries in major free directories, to the extent visible in search results, and submits corrections through free amendment channels or tells the customer which steps are needed. No specific number of directories is owed; Pakun AI does not book paid third-party services. The customer receives a monthly report; metrics from Google Business Profile statistics are reported only where access is available. The Review Booster (section 3i) is included.
(4) Reviews: Pakun AI does not write, buy or broker reviews and does not pre-screen customers according to their satisfaction. The customer is responsible for complying with Google’s policies and competition law when requesting reviews, in particular for not offering anything in return. Section 2b applies accordingly; Google independently decides whether to display or remove content. Pakun AI owes careful performance of the services, not rankings, calls, reviews or enquiries.
(5) Term and termination: The contract is indefinite and either party may terminate it at any time with effect from the end of the current billing month, in text form (an email to [email protected] suffices) or through the Stripe customer portal. There is no minimum term. Manager access ends when the contract ends; the customer may remove it themselves at any time. The review page continues to be hosted after the contract ends in accordance with section 3f(4).
(6) Price and payment: The price is €39 per month and is a final price; no VAT is charged under § 19 UStG. Monthly amounts are payable monthly in advance and automatically collected through the Stripe subscription. The invoice is emailed.
(7) Otherwise, these terms apply, particularly section 5 (Results and usage rights) and section 6 (Warranty and liability).
3i. Review Booster
For the Review Booster, available at pakunai.de/auftrag/bewertungs-booster/ and included in Pakun Sichtbar, the following supplements and overrides section 1 sentence 2 and section 3:

The customer then receives QR cards and a poster as PDFs, and text templates, by email. The page does not ask about satisfaction beforehand and directs all visitors equally to the review form. The legal notice and privacy notice are template texts based on the customer’s information and are not legal advice. Section 3h(4), sentences 1 to 3, applies accordingly. Pakun AI owes creation, not a specific number or particular content of reviews.
(4) Hosting: Pakun AI provides the page through Cloudflare Pages at no separate charge, at a Pakun AI address or a customer subdomain once the customer has set the required DNS record. Customers can update their information through the fact sheet at any time; changes are published after renewed approval. No specific availability is owed; Pakun AI remedies disruptions to the extent reasonably practicable. Pakun AI may terminate free hosting by giving three months’ notice to the end of a month in text form; the customer then receives the page files on request. The customer may terminate hosting at any time in text form.

3j. Review Check

(3) Service: Pakun AI assesses up to five Google reviews supplied by the customer against Google’s publicly available policies, gives a recommendation for each review (report, report with reasons, do not report) and creates a draft reply for each review (using a language model operated on Pakun AI’s own servers or fixed templates, automatically checked). Delivery is by email as a PDF and text file. If the customer has invited Pakun AI to be a manager of their Google Business Profile, Pakun AI reports only reviews where a violation is apparent, using the channels provided by Google, and publishes replies only with the customer’s consent in text form; otherwise the customer receives instructions for reporting reviews themselves.
(4) No deletion guarantee; no legal advice: Google alone decides whether a review is removed. Pakun AI owes a careful assessment, not removal of a review; no success-based fee is charged. The assessment is not legal advice; whether a review is unlawful can only be legally assessed in the individual case. The customer is responsible for the accuracy of their information, particularly concerning the reviewer’s contact with the business as a customer.
(5) Delivery: Generally within 24 hours and no later than three business days after receipt of the complete fact sheet.
(6) Price and payment: The price is €49 and is a final price; no VAT is charged under § 19 UStG. Payment is in advance through Stripe using the payment methods offered there. The invoice is emailed.

3k. Job Page with Google Jobs Markup
For the Job Page, available at pakunai.de/auftrag/stellenseite/, the following supplements and overrides section 1 sentence 2 and section 3:

Applicants apply directly to the customer by email or telephone; Pakun AI does not receive applications. The customer is responsible for the content of the job advertisement, particularly compliance with the German General Equal Treatment Act, the accuracy of salary and working-hours information and the expiry date; section 2a(3) applies accordingly. The legal notice and privacy notice are template texts based on the customer’s information and are not legal advice. Pakun AI owes creation of the page, not inclusion in Google job search or applications. Each vacancy requires a separate order.
(4) Hosting: Pakun AI provides the page through Cloudflare Pages at no separate charge, at a Pakun AI address or a customer subdomain once the customer has set the required DNS record. 3l. Website Migration and Handover of Website Files
For Website Migration, available at pakunai.de/auftrag/website-umzug/, the following supplements and overrides section 1 sentence 2 and section 3:
(1) Formation of contract: By submitting the order, the purchaser makes an offer. The contract is formed upon successful completion of payment through the payment service provider Stripe; no separate confirmation is required.
(2) Businesses only: Orders are available exclusively to businesses within the meaning of § 14 BGB. The purchaser confirms this by ticking the relevant box when ordering. There is no right of withdrawal, as this is available only to consumers.
(3) Service: Pakun AI creates a website of up to five pages in accordance with the “Website in 72 Hours” service description from the information in the customer’s fact sheet, provides it as a preview and publishes it only after customer approval. Pakun AI uses content from the previous website only insofar as the customer supplies it; the customer warrants that they hold the necessary rights. The customer receives instructions for domain migration; Pakun AI connects the domain to the new website once the customer has set the required DNS records. Terminating the previous contract, transferring the domain and the domain provider’s costs are the customer’s responsibility. Pakun AI does not owe any specific search engine ranking and does not provide legal advice.
(4) Hosting and maintenance: Hosting and maintenance cost €49 per month (final price, no VAT under § 19 UStG), payable monthly in advance through the Stripe subscription. They include hosting, updates and changes of up to 30 minutes per month, plus (a) a monthly automatic accessibility scan of the website with a short report sent by Pakun AI after its own review; the scan covers only some possible barriers, and there is no guarantee of website accessibility or BFSG compliance; (b) email forwarding for the customer’s domain to a mailbox specified by the customer, provided that the domain is managed in Pakun AI’s Cloudflare account; Pakun AI does not provide mailboxes; (c) display of the customer’s Google review star rating with a link on the website, updated monthly by Pakun AI; Pakun AI does not procure or broker reviews. Hosting and maintenance may be terminated at any time with effect from the end of the current billing month in text form (email suffices).
(5) Handover of website files: When hosting and maintenance end, Pakun AI provides the customer with their website files (HTML, CSS, images and texts) for their own use, upon request in text form, without additional charge. Pakun AI’s general templates, procedures and software (particularly the website generator) remain unaffected. This applies accordingly to “Website in 72 Hours”.
(6) Delivery: The preview is generally provided by email within 72 hours of receipt of the complete fact sheet.
(7) Price and payment: The price is a one-off €790 plus the monthly amounts under paragraph 4 and is a final price; no VAT is charged under § 19 UStG. Payment is through Stripe; the one-off amount is billed together with the first monthly amount. The invoice is emailed.
(8) Otherwise, these terms apply, particularly section 5 (Results and usage rights) and section 6 (Warranty and liability).
3m. Digital shop products (e-books, checklists, templates, prompt packs)
For purchases of digital products in the shop at pakunai.de/shop/, the following supplements and overrides section 1 sentence 2 and section 3:
(1) Submitting an order constitutes an offer. The contract is formed when Stripe payment is successfully completed; no separate confirmation is required.
(2) The shop is exclusively for businesses under § 14 BGB. The purchaser confirms this by ticking the relevant box. There is no consumer right of withdrawal.
(3) After successful payment, the files specified in the product description (PDF and, where applicable, a text file) are available on the confirmation page and via an emailed link. The link is available for 12 months from purchase; customers must save their files. If download is not possible, Pakun AI supplies the files again on request in text form.
(4) The customer receives a non-exclusive, perpetual, non-transferable right to use the files internally in their own business, including all employees. Templates and prompts may be adapted for their own business communications. Sharing files with third parties, publishing or reselling them, or using them as a basis for products for sale is prohibited.
(5) Products are working aids as of their stated date and do not replace legal or tax advice. No particular rankings, reviews, enquiries, revenue or other outcomes are owed. Third-party features and rules may change; ongoing updates are not owed.
(6) If a file is incomplete or unreadable, Pakun AI supplies a fault-free file following notification in text form; email to [email protected] suffices.
(7) The price shown at purchase applies. Prices are final; no VAT is charged under § 19 UStG. Payment is in advance through Stripe; the invoice is emailed.
(8) The remaining terms apply, particularly sections 5 and 6.
4. Deadlines
Delivery times, such as five to seven business days, are non-binding estimates. Written deadline agreements take precedence.
5. Results and usage rights
Audit reports and findings are supplied for internal business use. Disclosure to third parties requires consent unless legally required. After full payment, customers may use and edit texts, structured data and service pages created for them without time or geographical restriction on their own website, Google Business Profile and directory entries. Pakun AI general templates, procedures and software are unaffected and may continue to be used.
6. Warranty and liability
(1) Pakun AI has unlimited liability for intent and gross negligence, injury to life, body or health, fraudulent concealment of a defect and under the German Product Liability Act.
(2) For slight negligence, liability is limited to breach of an essential contractual duty: one necessary for proper performance and on which the customer may normally rely. Liability is limited to foreseeable damage typical of the contract and to fees paid by the customer in the 12 months preceding the damaging event. There is no liability for lost profit in cases of slight negligence.
(3) For data loss caused by slight negligence, liability is limited to restoration costs that would have arisen with regular, risk-appropriate customer backups.
(4) These limitations also benefit employees and persons engaged to perform contractual obligations or other tasks.
(5) Claims for defects become time-barred one year after delivery or acceptance. This does not apply to paragraph 1, where statutory periods apply.
7. Confidentiality and data protection
Both parties treat accessible information confidentially. Data processing follows our privacy notice and applicable requirements, including the GDPR. Where Pakun AI processes personal data on behalf of a customer, such as call data or customer-account data, the parties conclude a data processing agreement under Article 28 GDPR.
8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law or a special fund under public law, Berlin is the exclusive jurisdiction; Pakun AI may also bring proceedings at the customer registered office. Cancellations and other declarations require text form; email suffices. Individual agreements take precedence (§ 305b BGB). If a provision is ineffective, the remainder of the contract remains effective.
